2. Purpose and acceptance
This Legal Notice governs the conditions of access to and use of the Site. Accessing the Site implies that the visitor becomes a User and fully and unreservedly accepts all the provisions contained in this Legal Notice in the version published at the time of access.
MERGE reserves the right to modify at any time the presentation, configuration, contents and services of the Site, as well as these conditions, publishing new versions through the Site itself.
3. Conditions of access and use
The User undertakes to use the Site and its contents in an appropriate, lawful and diligent manner, in accordance with applicable law, morality, good practice and public order. In particular, the User undertakes to refrain from:
- Making unauthorised or fraudulent use of the Site or its contents.
- Accessing or attempting to access restricted resources or areas without meeting the required conditions.
- Causing damage to the physical or logical systems of MERGE, its suppliers or third parties.
- Introducing or disseminating viruses, malware or any system likely to cause damage.
- Reproducing, copying, distributing, transforming or modifying the contents without authorisation from the rightsholder.
- Removing, hiding or manipulating notices of intellectual or industrial property rights or any other identifying data of MERGE's or third parties' rights.
- Using the Site or its contents for purposes or with effects contrary to law, this Legal Notice, good faith or public order, harmful to the rights and interests of third parties, or that may damage, disable, overload or impair the Site.
4. Hyperlinks
The establishment of a hyperlink from another website to the Site does not imply any relationship between MERGE and the owner of the linking website, nor the acceptance or approval by MERGE of its contents or services. Anyone wishing to establish a hyperlink must request prior written authorisation from MERGE; in any case, the hyperlink will only allow access to the home page and must refrain from making false or inaccurate statements about MERGE or from including unlawful contents.
MERGE is not responsible for the contents or privacy practices of third-party websites linked from the Site.
5. Intellectual and industrial property
All intellectual and industrial property rights over the Site and its contents (including, without limitation, trademarks, logos, trade names, texts, images, graphics, designs, sounds, databases, software, presentation, audio and video) belong to MERGE or to third parties that have authorised their use. Access to the Site does not entail any assignment, transmission or waiver of any rights.
MERGE authorises the User to view, print, download and store the contents exclusively for personal, private and non-profit use, provided that the source and authorship are preserved and, where applicable, the copyright symbol is displayed. Any other use — including reproduction, public communication or distribution for commercial purposes — requires express written authorisation from MERGE or the rightsholder.
The trademarks "MERGE", "MERGE Madrid", "MERGE LatAm" and the associated logos are distinctive signs owned by MERGE.
6. Processing of personal data and cookies
The processing of personal data collected through the Site is governed by the Privacy Policy. The use of cookies is governed by the Cookies Policy.
7. Digital Services Act (DSA)
For the purposes of Regulation (EU) 2022/2065, of 19 October, on a single market for digital services ("DSA"), the Site constitutes an information society service of an informational and registration-management nature, which does not qualify as an online platform as defined in Article 3(i) DSA. Nevertheless, MERGE designates as its single point of contact for DSA purposes the email [email protected]. Communications may be sent in Spanish, English or Portuguese.
8. Accessibility
MERGE works to make the Site accessible to as many people as possible and reasonably endeavours to follow the WCAG 2.1 AA guidelines. If you encounter any accessibility barrier, please let us know at [email protected] and we will do our best to address it.
9. Exclusion of warranties and liability
MERGE does not guarantee the availability and uninterrupted operation of the Site or of any linked sites. To the maximum extent permitted by applicable law, MERGE will not be liable for any loss or damage arising from:
- the lack of availability or accessibility of the Site or of linked sites;
- interruptions, computer failures, telephone breakdowns, disconnections, delays or blockages caused by overloads in the network or electronic systems;
- the unsuitability of the Site for the User's specific needs;
- unauthorised intrusions by third parties beyond MERGE's control;
- the presence of viruses or other harmful elements introduced by third parties;
- the quality, reliability or accuracy of third-party contents published or linked on the Site.
Nothing in this Legal Notice is intended to limit MERGE's liability for wilful misconduct, gross negligence or for any liability which cannot be limited or excluded under the law.
10. Actions in case of non-compliance
MERGE reserves the right to take whatever legal action is available to it to demand the responsibilities arising from any breach by a User of any provision of this Legal Notice.
11. Partial invalidity
If any of the clauses of this Legal Notice is declared null or unenforceable, that declaration will not affect the validity of the remaining clauses, which will remain fully effective. MERGE's failure to require strict compliance with any of the terms at any given time will not constitute a general waiver of compliance with any other condition.
12. Applicable law and jurisdiction
This Legal Notice is governed by Spanish law.
For the resolution of any dispute, the parties, expressly waiving any other jurisdiction that may apply, submit to the Courts and Tribunals of the city of Madrid, without prejudice to the mandatory jurisdiction applicable to consumers under Article 90.2 of Spanish Royal Legislative Decree 1/2007.

For Users resident in Brazil and other Latin American countries, the local mandatory law protecting them will also apply.
