Important notice: these Terms of Service govern the use of the website https://www.mmerge.io. The purchase of tickets and attendance at MERGE events are also governed by the Terms and Conditions of Attendance to MERGE Events, which the buyer expressly accepts upon purchasing any ticket.
1. Purpose
These Terms of Service (hereinafter, the "Terms") govern the access to and use by the User of the website https://www.mmerge.io (the "Site") owned by Merge Digital SL ("MERGE"), as well as the services available through it: information about MERGE events, newsletter subscription, contact forms, press area, sponsor area, editorial content (Talks, On Stage, Insights), media kit and any other content or functionality published on the Site.

3. Acceptance
Use of the Site implies the User's express, full and unreserved acceptance of all the Terms in the version in force at the time of access. Users who do not accept the Terms must refrain from using the Site.
The Terms are supplemented by the Legal Notice, the Privacy Policy and the Cookies Policy, which form an integral part of these Terms.
4. Services provided through the Site
By way of example, through the Site MERGE offers:
- Commercial information about MERGE Madrid, MERGE LatAm and other editions, both historical and forthcoming.
- The possibility to purchase tickets to the events (subject to the Terms of Attendance).
- Newsletter subscription.
- Contact and sponsorship forms.
- Access to editorial content: articles, talk videos, podcasts, press materials.
- Press room information and media kit download.
MERGE reserves the right to modify, expand or suspend the provision of these services at any time without giving rise to any right to compensation.
5. Newsletter and marketing communications
Subscription to the newsletter requires the express consent of the User through a double opt-in process: after filling in the form, the User receives a confirmation email and must click the validation link contained in that email in order to finally activate the subscription.
The subscription form presents two separate and independent checkboxes:
- (a) Acceptance of the Privacy Policy and the Terms of Service.
- (b) Express consent to receive the MERGE newsletter with content, event news and exclusive discounts.
The User may unsubscribe from the newsletter at any time, easily and free of charge, through the unsubscribe link included in every communication or by writing to [email protected] with "Unsubscribe newsletter" in the subject line.
The data provided when subscribing will be processed in accordance with the Privacy Policy.
6. User-generated content
If the User sends MERGE comments, suggestions, photographs, videos or other content through the Site, MERGE's social media or by email, the User warrants that they hold all the necessary rights and authorises MERGE to use such content for communication and promotion of the event, in any format and medium, throughout the entire legal protection period of the assigned rights and worldwide. The User undertakes not to send unlawful, offensive, defamatory or rights-infringing content, or content that violates the dignity of persons.
MERGE reserves the right to moderate, edit or remove any content it considers contrary to the Terms or to applicable law.
7. Intellectual property
All contents published on the Site (texts, images, videos, audios, graphics, source code, logos, trademarks) are owned by MERGE or by third parties that have authorised their publication. Access to the Site does not grant the User any right of use other than mere consultation for personal and non-commercial purposes.
Any reproduction, distribution or public communication for commercial purposes requires express authorisation from MERGE. To request it, write to [email protected].
8. Limitation of liability
MERGE strives to keep the Site operational, up to date and error-free, but does not guarantee the uninterrupted availability of the service or the absence of errors. MERGE will not be liable for:
- Temporary interruptions due to maintenance, failures of hosting providers or force majeure causes.
- Damage arising from the User's use of the Site contrary to the Terms.
- Third-party content (sponsors, speakers, partners, media) accessible from the Site.
These limitations apply to the maximum extent permitted by applicable law and do not exclude MERGE's liability in cases of wilful misconduct, gross negligence or where such exclusion is prohibited by consumer protection law.
9. User conduct
The User undertakes to use the Site in a manner that respects third-party rights and complies with the law. The following conduct, among others, is prohibited:
- Carrying out mass or automated scraping, unless expressly authorised.
- Attempting to access restricted areas or breaching security measures.
- Impersonating third parties.
- Using the Site to send unsolicited commercial communications (spam) to other users.
- Any use that involves infringement of MERGE's or third parties' intellectual or industrial property.
Breach of these obligations may result in suspension of access to the Site and any corresponding legal actions.
10. Modifications
MERGE may modify these Terms at any time. The version applicable at any given moment will be the one published on the Site. Where the changes are material, they will be announced at least 15 days in advance through a notice on the home page or by email to subscribed users. If the User does not agree with the new Terms, the User must cease using the Site.
11. Language
These Terms are published in Spanish, English and Portuguese. In case of discrepancy between versions, the Spanish version will prevail.
12. Applicable law and jurisdiction
These Terms are governed by Spanish law.
For the resolution of any dispute, the parties submit to the Courts and Tribunals of the city of Madrid, without prejudice to the mandatory jurisdiction applicable to consumers under Article 90.2 of Royal Legislative Decree 1/2007.
