Terms and Conditions of Attendance to MERGE Events

Document applicable to all present and future editions of the events organised by Merge Digital SL under the "MERGE" brand, including MERGE Madrid, MERGE LatAm and any other event, side-event, hackathon or satellite activity.
1. Purpose and parties
These Terms and Conditions (hereinafter, the "Event T&Cs") govern the conditions for the purchase of tickets and attendance at the events organised by Merge Digital SL (Tax ID B-56893787, with registered office at Calle Gaztambide 57, Local 5, 28015 Madrid; hereinafter "MERGE", "the Organiser" or "we") by buyers and attendees (hereinafter, "Attendee", "You").
These T&Cs are expressly accepted upon the purchase of any ticket and are binding on all persons who access the event venue with such a ticket.
2. Events covered
By way of example, these T&Cs apply to:
- MERGE Madrid 2026 (Madrid, October 2026).
- MERGE LatAm 2027 (São Paulo, March 2027).
- Any subsequent edition of MERGE in Madrid, São Paulo, Buenos Aires or other venues.
- Hackathons, workshops, networking events, side-events and satellite activities organised by MERGE.
The specific details of each edition (date, venue, schedule, programme, prices, ticket categories, special conditions) are published on the official event page within https://www.mmerge.io.
3. Ticket purchase
3.1. Purchase channels
Tickets are purchased exclusively through:
- The official site https://www.mmerge.io.
- Sales platforms expressly authorised by MERGE.
MERGE does not guarantee the authenticity or validity of tickets acquired through non-official channels. The purchase from unauthorised third parties is at the buyer's own risk. The resale of tickets for profit is prohibited.
3.2. Ticket types
MERGE offers different ticket categories with different scopes, accesses and prices. By way of guidance, the categories marketed through the Site include:
- Discover Pass Day 1 — partial access limited to the first day of the main event, in accordance with the terms and schedule indicated on the official event page.
- Discover Pass Day 2 — partial access limited to the second day of the main event, in accordance with the terms and schedule indicated on the official event page.
- Standard — full access to the main event days indicated on the official page.
- Pro — full access plus contact through the Event App with speakers and sponsors and other services indicated on the official page.
- Business — full access to the main event and the Institutional Summit (where applicable), VIP Lounge, VIP Lunch and other premium services indicated on the official page.
In addition, MERGE issues internal non-commercial accreditations for Speakers, Media and Staff, subject to invitation or express accreditation by the Organiser.
The specific scope, date, price and conditions of each category are published on the official event page, which prevails over any general description. It is the buyer's responsibility to purchase the correct category. Fraudulent purchase of a category that does not correspond may lead to ticket cancellation without refund and to denial of access to the event.
3.3. Price, taxes and invoicing
Prices are shown on the official event page. Unless otherwise expressly stated, prices do not include the applicable VAT, which will be added at checkout. For events held in Spain, the Spanish VAT rate in force (currently 21%) applies regardless of the buyer's country of residence.
For events held in Brazil, the applicable Brazilian taxes (including ISS and any other applicable taxes) will apply and the invoice will be issued in accordance with local tax regulations.
Once the purchase is completed, the digital ticket and the electronic invoice will be automatically sent to the buyer's email.
3.4. Means of payment
MERGE accepts the means of payment indicated in the purchase flow: credit and debit cards of the usual brands (Visa, Mastercard, American Express), bank transfer and other methods that the Organiser admits in each edition. The payment gateway used is Stripe, operated by Stripe Payments Europe Ltd., to which only the data strictly necessary to process the payment is provided.
3.5. Confirmation
Once the purchase is confirmed and payment verified, the ticket is considered firm and binding. The ticket constitutes a personal and revocable licence of access to the event and does not transmit ownership of any other good or right different from the right of access under these T&Cs.
4. Refund, change and cancellation policy
4.1. General principle: non-refundable tickets
Tickets purchased are firm and, as a general rule, non-refundable. Pursuant to Article 103(l) of Spanish Royal Legislative Decree 1/2007, the right of withdrawal provided for distance contracts does not apply to tickets to events with a fixed date.
4.2. Name change
Unless expressly prohibited for the ticket category, the Attendee may request a name change up to seven (7) calendar days before the start of the event. The name change requires the payment of an administrative fee of 30 € plus VAT per ticket, and is processed by writing to [email protected] with "Name change" in the subject line. The new holder must meet the eligibility requirements of the relevant category.
4.3. Cancellation or total suspension of the event by MERGE
If MERGE is forced to cancel the entire event for reasons not attributable to force majeure (section 12), the Attendee will be entitled, at their choice, to:
- (a) A voucher for the full amount paid, valid for the next edition of the same event or, alternatively, for any other MERGE edition within the following 24 months; or
- (b) Refund of the amount paid, less non-recoverable payment gateway costs.
4.4. Cancellation due to force majeure
If the cancellation or total suspension of the event is due to a force majeure event under section 12, the Attendee may choose between:
- (a) Voucher for the full amount paid, valid for the next equivalent edition of the event or, alternatively, for any other MERGE edition within the following 24 months; or
- (b) Refund of the amount paid, less duly evidenced non-recoverable costs (in particular, the fees applied by the Stripe payment gateway).
MERGE assumes no cost related to travel, accommodation or other expenses incurred by the Attendee.
4.5. Significant reduction of the programme
If for reasons attributable to MERGE more than 50% of the scheduled sessions are cancelled or the venue is relocated more than 50 km from the originally published location, the Attendee will be entitled to a pro-rata refund or to an equivalent voucher, at the Attendee's choice.
4.6. Minor changes to the programme
The programme, speakers, schedules and arrangement of rooms are provisional and may be modified due to circumstances beyond our control. Specific speaker substitutions or time changes within the same day do not give rise to a right to a refund. MERGE will communicate substantial changes as far in advance as possible through official channels.
5. Access to the venue
5.1. Documentation
To access the venue the Attendee must present their digital ticket (QR code) and a valid official photo ID document (national ID card, passport or equivalent). If the information on the document does not match that on the ticket, MERGE reserves the right to deny access without refund.
5.2. Accreditation, wristband and lanyard
Upon arrival, the Attendee will receive their official accreditation (lanyard with badge), which must be worn visibly throughout their stay at the venue. The accreditation is personal and non-transferable. Loss or theft must be reported immediately at the Help Desk; reissue may carry an administrative fee that will be published in the event FAQ.
5.3. Room capacity
Access to specific rooms is subject to their maximum capacity. MERGE guarantees access to the venue but does not guarantee access to a specific room once its capacity has been reached.
5.4. Adults only (18+)
Access to the event is reserved for persons aged 18 and over. Minors will not be admitted under any circumstances. MERGE may request proof of age and deny access without refund.
5.5. Accessibility
MERGE works to ensure that the event is accessible to persons with functional diversity. If you require any reasonable adjustment (sign language interpreter, mobility assistance, sensory accommodations, etc.), please let us know at [email protected] at least 21 days before the event, with "Accessibility" in the subject line.
6. Code of Conduct
MERGE is committed to creating a professional, safe, inclusive and respectful environment. All Attendees, speakers, sponsors, staff and suppliers undertake to comply with the following Code of Conduct.
6.1. Expected behaviour
- Professional and respectful treatment of all persons present.
- Constructive communication, especially when disagreements arise.
- Respect for diversity of origin, gender, sexual orientation, gender identity, religion, age, disability, socio-economic status or any other personal circumstance.
6.2. Prohibited behaviour
The following are expressly prohibited, among others:
- Harassment of any kind, including sexual harassment, offensive comments, unwanted physical contact or following.
- Discrimination or hate speech based on any personal circumstance.
- Intimidation, threats or violent behaviour.
- Taking photographs or recordings of persons without their consent, especially in areas signposted as "no-photo".
- Dissemination of images or information that may be harmful to the dignity of any person present.
- Unauthorised commercial solicitation outside the dedicated spaces (sponsor booths, partner areas).
- Intentional disruption of talks, panels or event activities.
- Evident intoxication or use of illegal substances at the venue.
- Any conduct contrary to applicable law, venue rules or the safety instructions of the staff.
6.3. Reporting channel
If you are a victim or witness of conduct contrary to this Code, you may approach the event Help Desk or any identified staff member, or write to the dedicated safety channel: [email protected].
MERGE will handle all communications with the utmost confidentiality. The measures MERGE may take include, depending on the severity of the conduct, anything from a warning to immediate expulsion from the venue without refund, the prohibition of access to future MERGE editions and, where applicable, reporting to the competent authorities.
7. Processing of image, audio and video
7.1. Capture during the event
During the event, MERGE and/or authorised third parties will capture photographs, video and audio of the venue, talks, booths, common areas and attendees, for the purposes of graphic documentation, event promotion, dissemination on social media, website, marketing materials, after-movies, press and future editions.
7.2. General attendees: assignment with the right to object
By purchasing the ticket and accessing the venue, the Attendee accepts and consents that their image and voice may be captured and used by MERGE for the purposes described in section 7.1, in any format and medium, worldwide and for the entire legal protection period. The legal basis for this processing is MERGE's legitimate interest in accordance with the Privacy Policy.
Right to object. The Attendee may: (i) inform the MERGE staff at check-in that they do not wish to be photographed or recorded identifiably; (ii) request at any later time the removal of specific images by writing to [email protected] with "Image rights" in the subject line.
7.3. Speakers, panelists and moderators
Speakers, panelists and moderators sign in advance of their intervention the Speakers' Image Rights Assignment Addendum, by which they grant MERGE a broad assignment for the commercial and promotional use of their image, voice and intervention.
7.4. Sponsors, exhibitors and press
Active presence at booths or partner areas of the event, as well as press accreditation, implies the express acceptance of the capture and use of image and voice under the terms of section 7.1.
7.5. Recording by Attendees
The use of professional recording devices (interchangeable-lens cameras, drones, professional recording equipment) requires prior written authorisation from MERGE. Recording with personal devices for private use is allowed, provided that the right to the image of third parties, the Code of Conduct and the intellectual property of the presentations (section 8) are respected. Recorded content may not be used for commercial purposes without express authorisation from MERGE.
8. Intellectual property of the presentations
The talks, panels, presentations, slides, demonstrations and any material displayed during the event are protected by intellectual and industrial property rights of their respective holders (speakers, sponsors, MERGE). The reproduction, copying, distribution or commercial exploitation of such materials is prohibited without the express authorisation of the rightsholder.
MERGE may publish the official recordings of the talks on its channels (web, YouTube, social media), in accordance with the agreements signed with each speaker. Official publication does not authorise the Attendee to redistribute the content outside official channels.
9. Side-events and closed sessions
During the event, side-events, closed sessions, private roundtables or meetings under Chatham House Rule or NDA may be organised. Participation in such formats may require acceptance of specific conditions, including a non-disclosure agreement. Breach of an accepted NDA may give rise to the corresponding legal actions.
10. Health and safety
The Attendee undertakes to respect the evacuation rules, the instructions of the venue's security personnel and any health instructions that MERGE may communicate. MERGE may adopt sanitary prevention measures consistent with the recommendations of the competent health authorities.
11. Liability
11.1. MERGE's liability
MERGE undertakes to organise the event with due professional diligence. Save for wilful misconduct or gross negligence, MERGE's total liability towards the Attendee is limited to the amount actually paid by the Attendee for their ticket to the event.
MERGE will not be liable for: loss or theft of personal items at the venue; opinions or statements made by speakers, sponsors or third parties during the event; investment or business decisions made based on information received at the event (see also the Information and Risks page); indirect damage, loss of profits or loss of business opportunities; breach by the Attendee or by third parties.
11.2. Attendee's liability
The Attendee is liable for any damage that, through their negligent or wilful action or omission, they cause to MERGE, the venue, other attendees or third parties during the event.
11.3. Insurance
MERGE has third-party liability insurance for the event. We recommend that the Attendee have appropriate travel and health insurance, especially when the event involves international travel.
12. Force majeure
Neither party will be liable for non-performance of its obligations when this is due to a force majeure event: natural disasters, pandemics, declared epidemics, war, terrorism, decisions of public authorities preventing the event from taking place, general strikes, mass failures of telecommunications networks or supervening unavailability of the venue. The affected party must notify the other of the force majeure event as soon as it becomes aware of it. The consequences of cancellation due to force majeure are governed by section 4.4.
13. Personal data
The Attendee's personal data is processed in accordance with the Privacy Policy, which the Attendee declares to know and accept when purchasing the ticket.
14. Modifications
MERGE may modify these T&Cs at any time. The version applicable to each purchase is the one in force at the time of ticket acquisition, without prejudice to changes necessary to comply with mandatory law.
15. Language and translations
These T&Cs are published in Spanish, English and Portuguese. For attendees of events held in Spain, the Spanish version will prevail; for those held in Brazil, the Portuguese version will prevail; in other cases, the English version.
16. Applicable law and jurisdiction
16.1. Events held in Spain
The relations arising from MERGE events held in Spain are governed by Spanish law. For the resolution of any dispute the parties submit to the Courts and Tribunals of the city of Madrid, without prejudice to the mandatory jurisdiction applicable to consumers under Article 90.2 of Royal Legislative Decree 1/2007.
16.2. Events held in Brazil
The relations arising from MERGE events held in Brazil are governed by Brazilian law, in particular the Consumer Defence Code (Law 8.078/1990) where applicable. For the resolution of any dispute, the parties submit to the forum of the district where the event has been held (São Paulo, unless otherwise indicated).
